Rental Agreement

RENTAL AGREEMENT

 

THE PARTIES.

This Short-Term Rental Agreement (“Agreement”) made on {{reservation_date}} between the following:


Guest: {{guest_name}} (“Guest”), and
Host: {{host_name}} (“Host”).
 

THE PREMISES.

The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

Hereinafter known as the “Premises.”

LEASE TERM.

The Guest shall be allowed to occupy the Premises starting {{checkin_date}} from {{checkin_time}} and ending {{checkout_date}} at {{checkout_time}} (“Lease Term”).


 

QUIET HOURS/NOISE.

Quiet hours begin at 11:00 PM each night and continue until 7:30 AM. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding guests. The Guest is expected to behave in a civilized manner and shall be good neighbours with any residents of the immediate area. The Host uses a noise monitoring device, it does NOT record actual sounds or conversations, it simply monitors the noise level (measured in decibels). This will provide the Guest with an alert if the noise level can be heard in adjacent Premises.


 

OCCUPANTS.

The total number of individuals staying on the Premises during the Lease Term shall be a total of {{number_of_guests}} guests and {{number_of_pets}} dog(s) staying. All Guests must be registered.

  • Primary Booker Details: The main booker is required to provide their full name, email address, age, and home address.

  • Accompanying Guest Details: For all accompanying guests, we kindly request their full name and age. The primary booker's email address may be used.

This registration is a mandatory requirement for safety and compliance, ensuring we have accurate records, especially in the unlikely event of an emergency. If more than the authorized number of guests or dog(s) listed above are found on the Premises, this Agreement will be subject to termination by the Host.

 

BOOKING FEES.

The Guest shall pay the Host the amount as detailed during the booking process. All prices are subject to change until the time of booking. Prices are in CAD. Payment can be made by (VISA, MasterCard or AMEX).

The Cape Breton Marketing Levy, a tax that supports tourism marketing efforts in Cape Breton, is applied to all reservations. For Airbnb and VRBO bookings, this levy is included in the total base price.

PAYMENT SCHEDULE.

To secure the reservation, the Guest shall pay twenty-five percent (25%) of the total rental amount at the time of booking. An additional twenty-five percent (25%) of the total rental amount is due approximately one hundred eighty (180) days prior to the scheduled arrival date. The remaining fifty percent (50%) of the total amount is due approximately ninety (90) days prior to the scheduled arrival date.


For reservations made between one hundred eighty (180) and ninety-one (91) days prior to arrival, a payment of fifty percent (50%) of the total amount is due at the time of booking, with the remaining fifty percent (50%) due approximately ninety (90) days prior to arrival. Reservations made ninety (90) days or less prior to arrival require full payment at the time of booking.
 

DAMAGE WAIVER.

A non-refundable Damage Waiver fee of 17 CAD per night for all reservations in lieu of a damage deposit will be paid by the Guest. The waiver covers all minor accidental damage or breakage up to 250 CAD. Coverage does not cover extraordinary cleaning charges, damage resulting from negligence, leaving windows or doors open, or damage by a pet.

 

Guests must notify the Host of any damage during occupancy in writing within 24 hours.


PETS. 

Your Dog must be registered prior to arrival, this includes service animals.​

  • Only dogs one (1) year of age or older are permitted, as we are currently unable to accommodate puppies.

  • The one-bedroom units, Spruce and Juniper, can accommodate up to 2 Dogs. The two-bedroom units, Cedar and Birch, can accommodate up to 3 Dogs.

  • Dog fees apply to all dogs, excluding service animals, to cover the additional cleaning required. 

  • The Guest assumes all risk of damage and injury incurred by their Dog in or around the Premises.  

  • Dog damage is not covered by the damage waiver.  

  • Only social and 100% house-trained Dogs are permitted at the Premises for security and the protection of our Premises and other guests.

  • Always clean up after your Dog, this must occur in the designated area. Never around the cottages. 

  • Dogs must always be on a leash, this includes the beach.

  • Dogs must never be left in the cottage unattended

  • Any unwanted contact (intentional or unintentional) of your Dog with another guest, if resulting in a complaint, is prohibited.

 

We love dogs and understand how difficult it can be to find accommodations that welcome them. That is why we proudly offer our cottages as dog-friendly accommodations. We kindly ask all guests to follow the policies above so we can continue offering this experience to future guests.
Violation of the terms above will result in the immediate termination of the Agreement with no refund.

 

EV CHARGING.

There is an on-site EV charging station, which includes two charger options: a Level 2 Standard Tesla Charger and an EV Adaptor J1772. A fee of 20 CAD per night applies for this service.

SMOKING POLICY.

Smoking is strictly prohibited on the Premises, including the use of cigarettes, cigars, vaping devices, or any other smoking products.
 

SUBLETTING.

The guest does not have the right to sublet, assign, or transfer the Premises.

INSPECTION.

The Host has the right to inspect the Premises with prior notice as in accordance with Provincial law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with Provincial law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.
 

ACCESS.

The keys are stored in the lockbox located by the entrance door and must be returned there when not in use. The lockbox access code will be provided by email, through the booking platform, or via text message on the morning of your arrival. For security purposes, the keys are fitted with Apple AirTags to assist in locating lost keys.

 

The Host reserves the right to enter the Premises at any reasonable time during the Guest stay for essential maintenance or if the Host suspects damage has been caused or in case of any emergency. The Host will make reasonable efforts to contact you before entering the Premises.

MAINTENANCE AND REPAIRS.

The Guest shall maintain the Premises in a good, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. Regular cleaning will occur between guest stays. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall charge the Guest for damage to the Premises or its furnishings in excess of the damage waiver.

 

WINDOWS & DOORS.

Must be kept closed at all times. Guests will be liable for any water damage caused by open windows or doors. Guests must hold the door handle at all times while opening and closing the exterior doors, it can get very windy at the Premises and significant damage could occur to the door. Guests will be liable for any damage.
 

CLEANING.

No cleaning products can be used other than those provided. Use of any supplied cleaning products, liquids, tablets is strictly in accordance with usage instructions. All cleaning products must be kept out of reach of children.
 

PARTIES.

The Guest agrees that parties, including weddings, rehearsal dinners, family reunions or other such events must have prior written approval at the time of the Agreement, and that failure to disclose this information could result in eviction and forfeiture of all monies paid.

 

WRITTEN EXCEPTIONS. Any exceptions to the above mentioned policies must be approved in writing in advance.  Only consideration is made for Guests booking all 4 Premises.

 

HOST’S LIABILITY.

The Guest hereby agrees to defend, indemnify and hold harmless the Host (its Officers, Directors, Managers, Employees, Agents and Contractors) against any and all claims of personal injury, property damage, loss or death arising from the use of the Premises regardless of the nature of the accident, injury or loss and including all claims of personal injury, property damage, loss or death asserted by the Guest, guests of the Guest, any invitee of the Guest, or any other person entering upon the Premises at the request of the Guest. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance if such coverage is desired.
 

SEVERABILITY.

If any term or provision of this Agreement is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement, or invalidate or render unenforceable such term or provision in any other jurisdiction.


 

RISKS.

 

  • CLIFFS. The Premises is located by the ocean, within 200 feet of a 100-foot high cliff. The Guest acknowledges that there is no fence along the cliff.
     

  • WOOD STOVE. Always keep the Wood Stove door closed and never leave a fire unattended. Never use the Wood Stove with the kitchen range hood on as the Cottage will fill with smoke and the Guest will be liable for all resulting remediation costs. Without the use of the provided key to open and close the door, touching the Wood Stove or the Chimney while in use or after use will cause a severe burn. The Wood Stove is intended as a supplementary heating source and is not to be used between May 15th and September 21st.
     

  • HOT TUB. The Guest is responsible to seek the approval from a medical provider prior to use. The Guest must ensure the cover is on at all times when not occupied. Touching the Hot Tub Fire Box or Chimney while in use or after use will cause a severe burn.  As part of our safety and maintenance standards, a team member may stop by every three days to clean and treat the hot tub, ensuring it remains in top condition throughout the Guest's stay.

    Important note: In the event of extreme weather conditions (thunder and lightning or extreme temperature), there may be delays in the hot tub’s availability for the safety of our staff. For the Guest's safety, we advise against using the hot tub during these conditions.

     

  • HEIGHTS. The Guest acknowledges the risk present from the balconies, second story lookout, and glass barrier for the stairwell. The Guests must never climb on, push against or hang from these areas as there would be serious risk of injury or death if a fall occurred.
     

  • FURNITURE AND AMENITIES. For Guest safety, Guests must never climb, stand, or play on any indoor or outdoor furniture, fixtures, or amenities, including but not limited to railings, hot tubs, and wood stoves. Doing so may result in injury or damage. Please use all furniture and amenities only as intended.
     

  • LADDERS. The Guest must never use the ladders in the one-bedroom cottages. These are only for use to access the Premises Mechanical systems and storage, and are for employee use only.
     

  • WILD ANIMALS. The property is in a rural location and there is the risk of wild animals in proximity to the Premises.
     

  • CANDLES. Must not be used at any time, for any reason.

 

The Guest is aware of the above RISKS at the Premises and agrees that they are responsible for the safety of themself and all of those in their party, and on Ridge Side Drive. 

The Guest acknowledges they read the aforementioned RISKS.

ATTORNEY’S FEES.

The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.
 

USE OF PREMISES.

The Guest shall use the Premises for residential use only. The Guest is not authorised to sell products or services on the Premises or conduct any commercial activity.
 

ILLEGAL ACTIVITY.

The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behaviour shall cause immediate termination of this Agreement with no refund.
 

POSSESSIONS.

Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the Province’s required time period or two (2) weeks, whichever is shorter, the Host shall dispose of said items or possessions.
 

CANCELLATIONS.

The Host must be notified in writing for any Agreement cancellation. A no show is treated in the same way as a cancellation. There are no refunds within 60 days unless otherwise noted by the Refunds Policy below.
 

STORM POLICY.

No refunds will be given for storms/bad weather during the guests’ stay at the Premises or, for storms which cause a delay or cancellation of flights/transportation to/from the Premises.
 

REFUNDS.

There will be no refunds for issues of any kind related to COVID-19, travel issues, delays, illness, or family issues within 60 days of arrival.

  • For bookings of more than 7 nights or fewer: A full refund will be issued if cancellation occurs >90 days prior to arrival. If cancellation occurs <90 days prior to arrival, refunds will only be provided if the Host is able to re-book the stay. In such cases, the refund will be reduced by a 250 CAD administration fee and any difference in rebooked value.
     

  • For bookings of 7 nights or fewer: A full refund will be issued if cancellation occurs >60 days prior to arrival. If cancellation occurs <60 days prior to arrival, the same rebooking conditions as above will apply.

TRAVEL INSURANCE.

We highly recommend that all guests purchase travel insurance to protect against unexpected events, such as illness, weather disruptions, or unforeseen travel delays. Please note that we do not offer travel insurance directly, but many third-party providers offer comprehensive plans that can cover a range of situations. This provides peace of mind and helps protect your investment in your stay with us.

COMPLAINTS.

The Host should be notified as soon as possible of any issues and we will do our best to resolve them in a timely manner. Contact us via guestservices@ridgeonthechimney.com or message us via the booking platform you booked on.  The Guest will not at any time make, publish or communicate to any person or entity or in any public forum any defamatory or disparaging remarks, comments, or statements concerning The Host, or any of its employees or directors.  We only ask for your opportunity to make a situation right before leaving a review.
 

CAMERAS 

There are video doorbells at the entry of each Premises. In addition, there are cameras at the road entry of the Premises, looking toward the path up from the beach, and in the parking lot. The cameras do not cover the hot tubs, decks, windows or any other private areas. These are present for security reasons and to assist guests with any challenges accessing the Premises.

 

GOVERNING LAW.

This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.

 

COMMUNICATION.

The Host reserves the right to contact the Guest during their stay via text or telephone for essential maintenance communications, or in case of any emergency. Any other communications will be initiated by the guest.

Acknowledgment of Approval of Entire Agreement

By signing this Rental Agreement, the Guest acknowledges that their signature represents their approval of the entire agreement, including all areas specifically noted for initials. The Guest affirms that they have thoroughly reviewed and fully understand the terms and conditions of this agreement, encompassing those sections requiring initials.

The Guest further acknowledges that they have had the opportunity to seek legal counsel or advice, if desired, prior to signing this agreement. Their signature below signifies their informed and voluntary approval of the Rental Agreement in its entirety, encompassing the specific sections that necessitate initials. The Guest commits to complying with the terms and obligations outlined throughout the entire duration of the rental period.
